The Alberta government has introduced new legislation that would make individuals ineligible for Medical Assistance in Dying (MAID) if mental illness is their only underlying condition.
Premier Danielle Smith said the proposed law aims to strengthen safeguards and ensure MAID remains a measure of last resort. She emphasized that decisions around assisted dying are “permanent and irrevocable” and must be approached with extreme caution.
“This legislation strengthens safeguards and restores clear limits on eligibility to protect vulnerable Albertans,” Smith said. “Those struggling with severe mental health challenges need treatment, compassion and support, not a path to end their life at what may be their lowest moment.”
Justice Minister Mickey Amery introduced the Safeguards for Last Resort Termination of Life Act, which would formally restrict access to MAID in such cases. He said the bill is designed to ensure the procedure is only considered when no other options remain.
Under the proposed legislation, individuals whose sole medical condition is mental illness would not qualify for MAID in Alberta.
The move comes amid ongoing national debate over expanding MAID eligibility and how to balance patient autonomy with protections for vulnerable populations, particularly those facing mental health challenges.
