Rules and Regulations for any RED FM Contest unless otherwise stated:

These general contest rules and regulations (the “General Contest Rules”) are applicable to contests administered by South Asian Broadcasting Corporation (“RED FM”) live on-air and online (each “a Contest” or “the Contest” and collectively, the “Contests”).  The General Contest Rules may be supplemented by specific contest rules which will also govern a Contest (the “Specific Contest Rules”).

  1. CONTEST PERIOD: RED FM runs Contests periodically, the timing and duration of which are announced on-air and/or online on RED FM’s official website (the “Applicable Contest Period”). A Contest will run for the announced Applicable Contest Period, unless otherwise amended, modified, suspended, cancelled or terminated in accordance with the General Contest Rules or any Specific Contest Rules announced for the Contest.
  2. ELIGIBILITY: To be eligible to enter a Contest, an individual must be:
    1. a legal resident of the province of British Columbia;
    2. at least the age of majority as of the first day of the Applicable Contest Period;
    3. in possession of a valid Canadian Government issued photo identification; and
    4. if applicable, the sole owner of all right, title and interest, including copyright, artistic and moral rights concerning any work submitted to RED FM as part of a Contest, including without limitation any artistic, dramatic, literary, musical, cinematographic, photographic work such as music, video, drawing, painting, photograph, writing or any other form of work (the “Work”).

    None of the Contests are not open to any employees, officers, directors, agents and representatives of RED FM (including its parents, affiliates, subsidiaries and advertising or promotional agencies) or any Contest Sponsors (as defined below) as well as any immediate family members of such individuals, including but not limited to parents, siblings, children and anyone else residing in the same household.

  3. HOW TO ENTER: There is no purchase necessary to enter a Contest.  Any eligible individual may enter a Contest by following the instructions of the on-air host on how to enter and win a prize and/or the instructions announced online on RED FM’s official website.  Any material provided by the entrant, including without limitation, entry forms and any Work will not be returned to an entrant.  Please ensure your ballots are legible and complete.  Any ballots that are illegible, incomplete or irregular will be declared invalid.  All entry ballots become property of RED FM and none will be returned.
  1. CONTEST SPONSORS: Any sponsors of a Contest will be announced either on-air and/or online on RED FM’s official website during the Applicable Contest Period (any sponsors of a Contest are the “Contest Sponsors”).
  1. PRIZE: Various prizes may be available to be won as will be identified by the on-air host and/or online on RED FM’s official website.  The approximate retail value of a prize may vary and will be announced on-air and/or online on RED FM’s official website.  Alternatively, the approximate retail value of a prize is also available on request.   Any prize is provided on the following terms and conditions:
    1. no compensation will be provided should the actual prize value be lower than the quoted prize value;
    2. a prize must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except as in the sole discretion of RED FM;
    3. the winner is responsible to pay any additional expense associated with the prize, including but not limited to any taxes, fees or other expenses associated with the winner receiving the prize and otherwise taking title to the prize;
    4. no prize may be resold;
    5. all prizes are provided “as is, where is” without any representation or warranty being provided of any kind whatsoever;
    6. the use of any prize may involve inherent danger and risk, including without limitation, danger of injury (including death), damage to or loss of property and any prize is provided to the recipient solely at the risk of the recipient; and
    7. RED FM may substitute, in its sole discretion, any announced prize, in whole or in part, with a prize of equal or greater value if the announced prize cannot be awarded for any reason.

    The chances of winning a Contest are dependent on the number of eligible entries received by RED FM during the Applicable Contest Period and on the application of any judging criteria used to determine and declare a winner, if applicable.

  1. ADDITIONAL REQUIREMENTS: If an entrant is declared a winner of a prize, he or she must:
    1. provide proof of valid Canadian Government issued photo identification so as to confirm eligibility;
      1. PICKUP OF PRIZE: If an entrant is declared a winner, the winner must visit RED FM located at #201 – 8383A 128 Street, Surrey, BC  V3W 4G1 within the time announced on-air or and/or online on RED FM’s official website and: (1) provide proof of identification so as to confirm eligibility, (2) successfully complete the Skill Testing Question, and (3) execute the Prize Agreement and Release.  Failure to complete these steps within the required time will result in the declared winner forfeiting any right to the prize.  In such circumstances, and time permitting, RED FM reserves the right, in its sole discretion, to randomly select an alternate winner from the remaining eligible entries, or to cancel the Contest.
      1. RELEASE BY ENTRANT: Each entrant in a Contest releases and agrees to hold the Releasees harmless from any and all Claims in any form or by reason of any matter cause or thing whatsoever arising in respect to or in connection with, directly or indirectly: (1) the entrant’s participation in the Contest, (2) the entrant’s acceptance, receipt, use or misuse of any prize, (3) RED FM and any Contest Sponsors’ use of the Personal and Promotional Information (defined below) and any Work, as permitted by the General Contest Rules and/or Specific Contest Rules, and (4) any breach of the General Contest Rules and/or any Specific Contest Rules.
      1. INDEMNIFICATION BY ENTRANT: Each entrant agrees to hold harmless, indemnify and reimburse the Releasees from and for any sums whatsoever (including their legal fees and disbursements on a solicitor-client basis) incurred by any of the Releasees or paid by them to any person in connection with all Claims by third parties in any form or by reason of any matter cause or thing whatsoever arising in respect of or in connection with, directly or indirectly: (1) the entrant’s participation in the Contest, (2) the entrant’s acceptance, receipt, use or misuse of any prize, and (3) the entrant’s breach of any of the General Contest Rules and/or any Specific Contest Rules.
      1. PUBLICITY / USE OF PERSONAL INFORMATION: Each entrant grants RED FM and the Contest Sponsors the unrestricted right to us, without compensation, notification or additional consideration, his or her name, portrait, picture, voice and likeness as well as all materials created by RED FM and the Contest Sponsors for the Contest in connection with or arising from the entrant’s participation in the Contest and/or acceptance and use of any prize (the “Personal and Promotional Information”) for the purpose of administering the Contest, including but not limited to contacting the winner, announcing the winner, coordinating the provision of any prize with the winner or any Contest Sponsors and for publicity and promotional purposes relating to the Contest or any related contest, including, without limitation, the unrestricted right to broadcast, publish, produce, reproduce, distribute, translate, adapt, and otherwise use the Personal and Promotional Information and any Work in any and all media now known or hereafter devised in connection with publicity related to the Contest or any related contest.
      1. USE OF WORK: Each entrant agrees that by submitting any Work in connection with a Contest, the entrant is representing and warranting that he or she is the sole author and creator of the Work, that the Work does not infringe any rights of third parties and that the entrant has all right, title and interest, including copyright, moral right and artistic rights in and to the Work.  Each entrant further agrees that by submitting any Work in connection with a Contest, the entrant grants to RED FM, any Contest Sponsors, and their respective successors and assigns, the irrevocable right and exclusive licence, without compensation, notification or additional consideration to the entrant, to broadcast, publish, produce, reproduce, distribute, translate, adapt, and otherwise use the Work in any and all media now known or hereafter devised in connection with the administration of the Contest and for any publicity and promotional purposes relating to the Contest and any future related Contest.  RED FM reserves the right, in its sole discretion, to exclude any Work submitted in connection with a Contest on the basis of any concerns about whether such Work infringes any rights of third parties, including but not limited to copyright, moral rights, artistic rights, privacy rights, rights of personality and rights against defamation, obscenity or hate speech.
      1. RULES: Each entrant agrees that by participating in a Contest, the entrant is bound by the General Contest Rules and any Specific Contest Rules announced for the Contest, which are both subject to change without prior notice. Further, each entrant agrees to be bound by the decisions of RED FM with respect to the Contest, which decisions shall be final, binding and conclusive in all respects.  RED FM reserves the right, in its sole discretion, to disqualify any entrant found to be
        1. violating the General Contest Rules;
        2. violating any Specific Contest Rules announced for a Contest;
        3. tampering or attempting to tamper with the entry process, the Contest website (and any sites related thereto) or the Contest, in any way whatsoever; or
        4. misconducting themselves during the course of a Contest whether by acting in any unsportsmanlike, disruptive, abusive, harassing or threatening manner to any other person involved with or related to the Contest.
      1. AMENDMENT / TERMINATION: RED FM reserves the right, in its sole discretion, to modify, amend, suspend or terminate any of the Contests, the General Contest Rules and/or any Specific Contest Rules announced for the Contests, in any way, at any time and for any reason whatsoever, without prior notice.
      1. LIMITATION OF LIABILITY: The Releasees assume no liability for:
        1. any late, incomplete, inaccurate, illegible, lost, stolen, damaged or undelivered entries, notifications, responses, replies or other communications;
        2. any error, omission, interruption, congestion, deletion, defect or delay whether caused by computer hardware or software, telephone, internet, network, cable, satellite, server or any other hardware, software, technical or human errors that could affect the transmission of entries, notifications, responses, replies or other communications in relation to a Contest;
        3. any incorrect or inaccurate information provided in the administration of a Contest for any reason whatsoever, including and without limitation, due to tampering, hacking, incorrect website use, computer hardware or software, telephone, internet, network, cable, satellite, server or any other hardware, software, technical or human errors;
        4. any other errors, difficulties of any kind, whether human, mechanical, electronic, or otherwise, relating in any way to any Contest, including those errors, problems or difficulties that may relate to the administration of a Contest, the processing of entries, the advertising of a Contest, the announcement of any prize or prize winner, or the cancellation or postponement of any event; and
        5. any decision to modify, amend, suspend or terminate any of the Contests, the General Contest Rules and/or any Specific Contest Rules announced for any of the Contests, in any way, at any time and for any reason whatsoever, whether for reasons outside the control of the Releasees or otherwise.

        Further, each entrant agrees that any and all claims, judgments and awards shall be limited to actual out-of-pocket expenses incurred for the entrant to enter a Contest, which costs shall in no event include lawyer’s fees, punitive, incidental and consequential damages or any other damages, other than for actual out-of-pocket expenses.

      1. GOVERNING LAW: Each entrant agrees that any disputes, issues or claims arising from, in respect to or in connection with, directly or indirectly, a Contest, the General Contest Rules and/or any Specific Contest Rules announced for a Contest, including but not limited to the construction, validity, interpretation and enforceability of the General Contest Rules, any Specific Contest Rules, or any determination of the rights and/or obligations of any entrants, RED FM and/or the Contest Sponsors shall be exclusively governed by the laws of the province of British Columbia and any applicable federal laws therein.  Any such disputes, issues or claims shall be resolved individually without resort to any form of class action or representative action.  Further, any proceedings must be brought in the courts of the province British Columbia sitting in Vancouver, British Columbia.
      1. SEVERABILITY: If any provision of the General Contest Rules, any Specific Contest Rules announced for a Contest, or both shall be held to be invalid or unenforceable, such decision shall not affect the validity or enforceability of any other provision of the General Contest Rules and any Specific Contest Rules announced for a Contest, which shall remain in full force and effect.
      1. SOCIAL MEDIA: While some of the Contests may be promoted or administered by means of third party, social media services, including and without limitation, Facebook, Twitter or Instagram, no such Contests are sponsored, endorsed or administered by any such third party, social media services. Any questions, comments and/or complaints regarding such a Contest should be directed to RED FM only.
