Fraser rejects Alberta Premier’s call for greater role in judicial appointments

Federal Justice Minister Sean Fraser says the selection of judges must remain free from political pressure, responding to comments from Alberta Premier Danielle Smith suggesting the province could limit funding if it is not given more say in the appointment process.

In a letter to the prime minister, Smith called for Alberta to be consulted on future appointments to the Court of King’s Bench, the Alberta Court of Appeal and the Supreme Court of Canada.

Fraser said the federal government will continue to follow the existing appointment system, stressing that judicial independence depends on judges being able to rule without fear or concern about pleasing those who hold political power.

He added that safeguarding that independence also means avoiding what he described as political threats related to court resources or funding.

According to Fraser, the current system is effective and already includes independent advisory committees that consider input from provinces when evaluating candidates.

While the federal government is responsible for appointing and paying judges on Alberta’s superior courts, the province covers the costs of court operations and support, including judicial assistants, legal counsel, sheriffs, court clerks and office resources such as furniture, cellphones and computers.
