Springbank Hill residents will return to Calgary city council chambers on Tuesday after losing a court bid to halt a rezoning hearing tied to a proposed townhouse development in their southwest community.

The 42-unit Agusta Villas project is slated for an undeveloped lot in the neighbourhood, but residents say it will worsen traffic, strain parking, and overshadow nearby homes.

On Monday, a Calgary judge denied their request for an injunction, ruling that city council’s agenda is not subject to judicial interference. While acknowledging the concerns raised, the court left the decision in the hands of council.

With Ward 6 currently unrepresented following the resignation of Councillor Richard Pootman, residents are urging the councillors now sharing the ward’s responsibilities to delay the hearing until after the upcoming municipal election.

“Ultimately, we’re at the council’s mercy, and so we are pleading for them to do the right thing. This is their final chance to do the right thing and to defer this matter until we have an elected councillor following the municipal election,” said resident Sarah Austin.
